If you disagree with any part of these terms and conditions, please do not use our website.

This website is operated by Country & Stable LLC (referred to as "Country & Stable/www.countryandstable.com/we/our/us"). As user of this website referred to as "you/your") you acknowledge that any use of this website including any transactions you make ('use/using") is subject to our terms and conditions below:

1. General

1.1 Our terms and conditions may be changed at any time and these changes will apply as soon as they are published on this website. We recommend that you read these terms and conditions every time you use this website as they may have changed since the last time you used this website.

1.2 You confirm that you have the authority to bind yourself or any business that you represent to these terms and conditions.

1.3 Where a service on this website requires registration you will be required to use an approved login name and password which must be used at all times that you access that service. You must provide complete and accurate information. Your password details must not be divulged to anybody else and you should tell us if you have any concerns about the use or misuse of your password details.

2. Order Acceptance

2.1 When you have completed your order we will send you an email acknowledging your order and detailing the products you have ordered. For the avoidance of doubt this email does not constitute an order confirmation nor order acceptance from us.

2.2 Your order will have been accepted and the contract between you and us will be completed when we despatch to you the products that you have ordered. Until that time we may decline acceptance of your order. See additionally clause 4.1 below.

3. Delivery & Payment

3.1 On this website where estimated timescales for delivery are given we will make reasonable efforts to deliver goods within those timescales. Delays are sometimes inevitable due to uncontrollable factors and we shall be under no liability for any delay or failure to deliver the products within estimated timescales.

3.2 Risk of loss or damage of products passes to you when products are delivered or when the first attempt at delivery of the products has been made.

3.3 In order to protect both you and us we will validate personal and payment information supplied by you during the ordering process with your card issuer and approved third party organisations. You agree to these checks being carried out and payment being taken at this point. Information that you provide will be treated as strictly confidential and not shared or sold on. We do not keep or store your payment information.

3.4 We try to ensure that all prices on the website are correct but errors may occur. Where we discover an error in the price of goods that you have ordered we will inform you as soon as reasonably practicable and give you the option of paying the correct price or cancelling your order. If you cancel your order we will give you a full refund. If we cannot contact you we will treat the order as cancelled.

3.5 Title to any products ordered passes to you after we have received full payment and the products have been delivered.

3.6 We offer free standard delivery on all orders $50 and over to the USA. All orders to the USA under $50 can be dispatched using our standard service at a cost of $19.95. All orders of in stock items usually take 5-7 working days.

3.7 All payments are processed at the point of order placement. Should we not be able to fulfill your order you will be refunded in full. Should we not be able to fulfill your order you are not entitled to any compensation.

4. Returns and Cancellations

4.1 If you return to us items purchased within 30 days of the shipping date in perfect condition, complete with the original packaging and tags, we will be happy to exchange or refund you with the original price. This does not affect your statutory rights.

4.1.1 We have extended our returns policy for Christmas orders until the 31st January. Any order purchased on or after the 1st of November is eligible for return in conjunction with other return policy T&C’s.

4.2 Items returned after 30 days or items that have been soiled or damaged will not be refunded nor will they be eligible for exchange. For this reason please ensure that any items returned to us are appropriately packaged to avoid damage in transit.

4.3 All products returned as faulty have to be returned to the manufacturer by us as soon as we receive them from you for inspection prior to refund or exchange. All products must be returned clean and dry. The decision whether to refund or exchange will be made by the manufacturer. Please be aware this process can take up to 21 days.

4.4 All US returns are free of charge.  Any postage costs for returns coming from outside the US will be a personal expense. Contact our customer service team to arrange your free return of your purchases if you are in anyway unhappy with your purchases.

4.5 When a US customer is returning purchases for exchange or refund, Country & Stable LLC bears and accepts no responsibility for returns lost in transit where the customers chosen method of return fails to deliver the returned products should you decide not to use the method provided by Country & Stable LLC. Country & Stable LLC bears and accepts no responsibility for any lost parcels coming from outside the US.

5. Intellectual Property

5.1 You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of your use of this website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorized by us or our licensors.

5.2 You acknowledge and agree that the material and content contained within this website is made available for your personal non-commercial use only and that you may only download such material and content for the purpose of using this website. You further acknowledge that any other use of the material and content of this website is strictly prohibited and you agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works or such material and content.

6. Liability and Indemnity

6.1 Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law.

6.2 Country and Stable LLC will use reasonable endeavors to verify the accuracy of any information on the website but makes no representation or warranty of any kind express or implied statutory or otherwise regarding the contents or availability of the site or that it will be timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the website. Country & Stable will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and Country & Stable LLC accepts no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site.

6.3 Other than as expressly provided in these terms and conditions with respect to specific products and except for the exclusive remedies set out at Section 5 above, any indemnities, warranties, terms and conditions (whether express or implied) are hereby excluded to the fullest extent permitted under applicable law.

6.4 Subject to Section 6.1 above, Country & Stable LLC will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or otherwise out of or in connection with the terms and conditions for any:

6.4.1 economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings); or

6.4.2 loss of goodwill or reputation; or

6.4.3 special or indirect losses. Suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.

6.5 Notwithstanding the above, subject to Section 6.1 Country & Stable's aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the products(s) in respect of one incident or series of incidents attributable to the same clause.

6.6 We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorized access to information provided by you.

7. Miscellaneous Provisions

7.1 The contract between us shall be governed by the laws of the United States of America and any dispute between us will be resolved exclusively in the courts of the United States of America. English is the only language offered for the conclusion of the contract.

7.2 We have selected our products on the basis that they will be used for leisure use only, if you are planning to use them for business purposes please make sure that you are covered by the appropriate insurance. Where you decide to use the products in the course of a business, we exclude (to the fullest extent permitted by law) those warranties and conditions relating to fitness for a particular purpose. Our maximum liability to business users arising out of or in connection with the products shall be limited to the replacement value of the product in question (except in the case of death or personal injury caused by our negligence or in respect of fraud). In relation to business users, we do not accept liability for the fitness of goods for business purposes, nor do we accept liability for the fitness of goods for business purposes, nor do we accept liability for loss of use of the item nor any loss over and above the cost of the item in the event of a claim for breach of warranty or condition.

7.3 Country & Stable shall be under no liability for any delay or failure to deliver products or otherwise perform any obligation as specified in these terms and conditions if the same is wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control.

7.4 To provide increased value to our customers, we may provide links to other websites or resources for you to access at your sole discretion. You acknowledge and agree that, as you have chosen to enter the linked website we are not responsible for the availability of such external sites or resources, and do not review or endorse and are not responsible or liable, directly or indirectly for:

7.4.1 the privacy practices of such websites; and/or

7.4.2 the content of such websites, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites or resources; and/or

7.4.3 the use to which others make of those websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of, or reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources.

7.5 You may not assign or sub-contract any of your rights or obligations under these terms and conditions or any related order for products to any third party unless agreed upon in writing by Country & Stable.

7.6 Country & Stable reserves the right to transfer, assign, novate or sub-contract the benefit of the whole or part of any of its rights or obligations under these terms and conditions or any related contract to any third party.

7.7 If any portion of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms and conditions shall not be affected.

7.8 No delay or failure by Country & Stable to exercise any powers, rights or remedies under these terms and conditions will operate as a waiver of them nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing and signed by an authorised representative of Country & Stable.

7.9 These terms and conditions including the documents or other sources referred to in these terms and conditions supersede all prior representations understandings and agreements between you and Country & Stable relation to the use of this website (including the order of products) and sets forth the entire agreement and understanding between you and Country & Stable for your use of this website.

7.10 From time to time we issue offer codes and seasonal reductions. Once a code has expired it cannot be used against a purchase. Only one coupon code can be used in any one transaction. All products subject to availability. Selected brands excluded. Discount codes and reductions cannot be applied retrospectively. Please see further conditions below regarding individual codes.

7.10.1 Premier Club Code valid until 12/31/23 10% off first full price online order. One code use per subscriber. Code can not be used against sale items or Flex-On products and cannot be used in conjunction with any other promotion(s).

7.11 Entrants must complete all instructions in order to be entered to win. Open to USA residents only. Entrants under 16 must seek a parent or guardian permission to enter. Winner will be picked at random and contacted by email/ DM within 7 days of the closing date. The chosen winner must respond within 28 days to claim their prize. If no response is received an alternative winner will be chosen. Prize will be delivered within one month of closing date, Prize(s) subject availability. No cash alternative. Prize is non-transferable. Only one competition entry per person. Competition can be rescinded at any time. Employees of Country & Stable or anyone else connected in any way with the competition or helping to set up the competition shall not be permitted to enter the competition. Winners maybe used for publicity with the authorisation of the winner.

7.12 Country & Stable gift certificates are valid for a period of 12 months from the date of purchase. Minimum amount to be applied to gift certificate $5. Maximum amount to be applied to gift certificate $5000. Each gift certificate shall be sent free of charge to the email address provided at point of purchase, can be redeemed to pay for either the whole or any part of an on-line order for eligible products at www.countryandstable.com. If the purchase exceeds the redeemer’s gift certificate balance, the remaining amount must be paid with another payment method. No credit or change will be given on the unused portion of the gift certificate. The gift certificate balance cannot be exchanged for cash or redeemed against the purchase of another gift certificate. This gift certificate is non-refundable and non-transferable. No replacement for lost or stolen gift certificate. Purchases will be subject to availability of products. The terms and conditions of this gift certificate shall be amended at any time at the discretion of Country & Stable and shall be binding on the customer. If you should experience issues redeeming your gift certificate with the unique code that has been sent to you, please contact customer services on info@countryandstable.com.

7.13 Country & Stable LLC reserve the right to update and amend our terms and conditions at any time. No written notice will be given of any changes.

7.14 Nothing in these terms and conditions will affect your statutory rights.
